“In a further instalment of the judicial pensions litigation, Andrew Sugarman successfully appeared at the EAT last week on behalf of a former Valuer Vice President of the First Tier Tribunal (Property Chamber). Robin Allen QC and Andrew Short QC were acting for other members of the judiciary. Langstaff P acceded to a request to effectively allow part of the appeal to leapfrog the EAT to join up with the O’Brien v MOJ case in the Court of Appeal, which will be heard next year, and gave permission to appeal on other grounds. The cases raise important issues concerning when time starts to run and the period of claim for those excluded from pension schemes on the basis of their part time status.”
